These Terms of Service ("Terms") govern your access to and use of the NexVend point-of-sale platform, applications, and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Accounts
You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity that occurs under your account. You must notify us promptly of any unauthorised use.
2. Trial & Subscriptions
NexVend is offered on a free trial and paid subscription basis. Fees, billing periods, register limits, and user limits are those shown for your selected plan. Paid plans renew for successive terms unless cancelled before the renewal date.
3. Acceptable Use
You agree not to misuse the Service, including by attempting to gain unauthorised access, interfering with its operation, reselling access without authorisation, or using it to violate any applicable law. We may suspend accounts that breach these Terms or that put the Service or other customers at risk.
4. Your Data
You retain ownership of the business data you enter into NexVend. We process it to provide the Service, including syncing between your devices and generating reports. We apply reasonable technical and organisational measures to protect it, but you are responsible for maintaining your own backups where required.
5. Availability
NexVend is designed to keep working offline and to sync when a connection is available. We aim for high availability but do not warrant that the Service will be uninterrupted or error-free, and we may perform maintenance from time to time.
6. Limitation of Liability
To the maximum extent permitted by law, NexVend is provided "as is" and we are not liable for indirect, incidental, or consequential damages, or for loss of profits, revenue, or data, arising from your use of the Service.
7. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination you may, for a reasonable period, request an export of your data where technically feasible.
8. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
